Legal Question in Family Law in Ohio

My husband & I have been separated over 2 years. We have 2 kids that live with him in Missouri. I live in Ohio & I pay child support. He's been unemployed over 2 years. Can I claim the kids on my taxes?

In Ohio, this issue is usually dealt with in the Entry that the Court filed to close up your case. If the Court did not determine who gets the tax deduction, and/or if the decree says the other party gets the deduction but something has changed that you feel makes it more equitable that you get the tax deduction, then you could file a motion to modify the order.
