Marital Separation

My husband and I have been married for 3 years. We have a 3 year old. He has a drug problem, lost his job and is moving out. I purchased the home before we were married. I have already filed for child support. What steps do I need to follow to file for separation and what should I expect to happen? How long does it take? How much does it cost? Also, he has mentioned taking out a distribution from his retirement plan. Would our daughter or I have any claim to the funds? Thank you very much for your time!

Do you mean separation, dissolution or divorce? You need to gather information regarding your assets and how they will be divided between the two of you. Employer retirement funds accrued during a marriage are considered marital assets.
