Legal Question in Family Law in Ohio

i was married 12 yrs, divorced in 1979 now retired and receiving ss for 2 yrs, my ex-husband is also retired and receiving only a pension from his job. am i entitled to part of his pension since we were married more than 10 yrs? dose this have to be stipulated in a divorce decree? which it isn't. if i am entitled how do i proceed from here.

You can possibly collect if you are unmarried, at least 62, were married at least 10 years, and the amount you currently collect is under the amount your ex-spouse is collecting or could collect. The federal government gives you this money and it is not deducted from your ex-spouse's amount. It does not have to be in your divorce decree.
