Legal Question in Family Law in Ohio

What about men's rights when the shoe is on the other foot.

My question is about spousal support. I have recently started back to work from being on disability, but who can say how long this will last, being that I have a tumor in my abdomen. During a time while discussing reconciliation I was diagnosed with cancer. It is non-operative and non- treatable. I must take 60mg Oramorph 3x a day and Oxycodone for breakthrough for the rest of my life.It seems that at that point in our marriage, my wife turned her back on me. My wife who works full time, neglected to allow me medical benefits from her job which is the result of my misprognosis, am I elgible for spousal support? Also, if she is married to me, can she be sued for being engaged to someone else before our divorce is final? If a man was working and his wife fell ill(termenally) would not the spouse be liable for at least medical???

Being engaged to someone is not the problem. If in this modern world they consumated the marital act then your wife has committed adultry, a ground for divorce. A spouse is required to provide "necessities" to the other. It should have been her obigation to include you in the insurance plan. As to spousal support, you get approximately one year of spousal support for every 4 years of marriage. Due to your illness, there may be extenuating circumstances to give you more spousal support.

As to the engagement question, that is adultery. You can ask the court for anything that you believe that you're entitled to for spousal support. There is no set formula. I believe that your wife should at least be required to make an effort to get you health insurance.
