my step daughter

my 12 year old step daughter accused me of molesting her on her birthday and I have never touched a child in the wrong way and the social worker told her that they are going to place her with a registered felon which is her father who also smokes marijuana and would rather spend all of his money on racing memorabealea. the only thing is that his mother has money and she pays all of his bills except his cell phone bill and I was wondering if they were able to do that seeing that I have no felony record at all. so please reply back to me because this is starting to upset my fiance and myself. thank you

You need to talk directly to an attorney as soon as possible! I understand that you are innocent of any wrongdoing but if there is a recommendation that your fiance's daughter be removed from her home then someone is listening seriously to what she has to say. There are a lot of innocent people sitting in jail as a result of these types of accusations.

Can your fiance's daughter be placed with her father? Yes. If the Juvenile Court determines that there is a reason for temporary custody to be given to the County, then they will have the authority to place the child. Mom will have the right to object and the Court may have to make the final decision.

Talk directly to an attorney! I suggest an experienced criminal attorney who has dealt with these types of cases! Your fiance may need to talk to an attorney experienced in custody and Juvenile Court matters.

If CSB is involved (has temporary custody) then yes, they can do that. If his case is in juvenile court, you need a lawyer.
