Legal Question in Medical Leave in Ohio

Fmla

My place of employment wants me to have a fitness for duty test done due to them thinking that the stress of the job is making my anxiety condition worse and that i may not be fit for the job as a corrections officer - what recourse do i have?

Re: Fmla

That is a very difficult question to answer with the limited information provided and the space limitations of this forum, particularly because of the interplay and potential implication of both the Family and Medical Leave Act and the Americans with Disabilities Act. In some instances, employers can request exams or fitness-for-duty certifications while in others, they cannot. I recommend that you consult with an employment attorney in your area, some of whom may be willing to provide a free consultation.
