Legal Question in Civil Litigation in Ohio

family

I am writing on behalf of a family who recently lost their mother. She has four adult children and her house has to be sold.

One of her children is a 50 year old woman who is mentally ill. She is very disagreeable. She refuses to do anything she is asked as far as sellng her mother's house is concerned.

My question is what can be done about the sister who is ill? She is the type who will threaten to sue her siblings if she doesn't get her portion of the money even though she may say she doesn't want it.

Your advice will be most appreciated. Thank you.

Re: family

Dear Inquirer: The family may require petitioning the Probate Court for Order of Partition or Sale, to permit proper sale of the real property and division of proceeds according to a will or , if there is no will, then by Intestate Succession.

An attorney should be consulted to assist you.

Good luck.

Sincerely, J. Norman Stark, Cleveland, Ohio
