Legal Question in Insurance Law in Ohio

Health Insurance

While my parents where visiting me last november my mother had to be taken to the hospital.She was covered by romanian medical travel insurance.She is a romanian citizen and she lives in Romania.

Because the health insurance doesn't want to pay the bills my mom made an apeal a month ago but they didn't come to any decision yet.

My question is if she can be sued by the hospital for not paying the costs of the hosptalization and what other actions they can take against her.

Also if she will have a law suit in Usa she will be able to visit me again(I am her daughter and I live in Usa)or to immigrate to Usa?

Who issued the travel insurance? It may be easiest to simply have the insurance carrier pay the bills. If they are subject to Ohio law, which is very possible under a theory known as "long arm jurisdiction", your mother may have a very good "bad faith" claim against the insurance carrier. This can be done here in Ohio, even if it is a Romanian carrier, much in the same way your mother can be sued, even though she is a Romanian citizen residing in Romania. Should your mother be sued, it would be best for her to defend the suit. She will have to be "served" with a copy of the lawsuit in accordance with applicable Interanational Treaties. I would suggest you contact an attorney familiar with litigation, international law and immigration law. I would be more than happy to discuss this with you further.
