Legal Question in Insurance Law in Ohio

life insurance beneficiaries

My father just recently passed away. As a family, we assumed my father had no life insurance and took on the burden of paying for funeral costs. Weeks later, while cleaning out his apartment, we (sister and two brothers) came across a paper indicating that he may have life insurance. Upon calling, I find out that he indeed has life insurance. The problem and the reason for my question is this. He had not changed his beneficiary since 1984. At that time he was married to my stepmother and because of this, she is beneficiary. My father divorced her in 1989 and as a family, we have not had contact with her since then. Do we as a family have no choice, but to watch as she collects the benefit? Does she still have legal claim to this as she is the beneficiary?

Re: life insurance beneficiaries

Probably, unless the divorce papers make some reference to it.
