Is a small restraunt allowed to pay an employee under min. wage at the age of 18 or older ?

If the restraunt is based on tips or commission the employee can waive mimimum wage protections. However in most cases the minimum wage will depend on the size of of the entity and the type of business and whether any federal or state funding is involved.

It would depend on if tips are an issue; if tips are not an issue, then it would go to number of employees.
