Legal Question in Employment Law in Ohio

I work for a small town in Ohio. WE have followed the Ohio revised code for our benifits such as days off, sick leave etc.

We are P.E.R.S. Our town council has decided to take away 9 of our 14 sick/personnel days yearly and 4 paid holidays as allowed by the Ohio Revised code. We have always had these benifits ,same as any state,government agency.

Since we are a small municipality ,can they do this to us,

Hello,

I haven't worked in public employment law for awhile, however, as far as I know, your sick leave accumulation is governed by ORC Section 124.38. That section grants sick leave accumulation to municipal employees of 15 days per year.

If you are represented by a union, you should immediately have your local steward or president look into this issue. If you are not represented by a union, you should look for a local attorney with a good reputation in your community to help you with this issue. (I work a full-time job other than private practice, so I would not be able to take your case.)

Good luck with this. There is a lot of anti-employee sentiment in Ohio right now, but I think that you have a clear right to sick leave accumulation under the Revised Code.
