Legal Question in Landlord & Tenant Law in Ohio

Landlord said he will sue me fore breaking lease

I moved in to a house in Columbus Ohio in July. Singed a 12 month lease. I made it eight months. I sold a house and moved into this place quickly. Several things were promised to be completed after I moved in and were never done. Found mold all over the house. Landlord was unresponsive. I have two year old daughter and did not want her to be around the mold. Also the house did not have gutters and water was flooding the basement which could be reason for mold. I had a 700 dollar deposit and rent was 700 a month. Four month left on lease, and I could not handle living conditions and mold. Now landlord said he will sue if I dont come up with money. I sent a several letters saying I would move.

Please advise.

Mike

If there is a mold problem, your landlord is required to address it. If he doesn't, you are entitled to place your rent in escrow, which he cannot get to until the problem has been fixed. It is usually a bad idea to just not pay rent. Failure to do so can lead to an eviction, which will show up on your credit report.

Are you still living in the house? If so, I would suggest looking into placing the rent money due for this month in escrow. It might also help to have a letter from an attorney explaining why the rent is being placed in escrow and demanding the mold issue to be fixed.
