Legal Question in Medical Malpractice in Ohio

What can I do when a Dr. didn't fix my daughters broken arm correctly?

My 10 yr old daughter broke her arm Oct 1. Surgury was done on the 10th and pins were put in it. I repeatedly told this Dr. that her arm didn't look right. He would tell me that it would after it finished healing. Now2 1/2 months later, he wants to break it again because he doesn't ''like the looks of the bone or the scar''. I have found another Dr. today. Hopefully, he can fix it correctly the first time. I do not want to pay the first guy a dime, though my insurance has already started to. What do I do?

My first question would be: did the new physician actually said that your daughter wasn't treated appropriately? All bad results are not necessarily the result of negligence on the part of the physician. At the present time, you are still liable for the bill to the first physician.

If you wish to investigate the matter further to determine if the physician was negligent, then you will need to retain an attorney who will obtain your daughter's medical records and x-rays and have them reviewed.

If you require additional information, please contact me or another attorney.
