Legal Question in Personal Injury in Ohio

fall

I fell and broke my foot while walking on a public sidewalk. I heard the paramedic say the walk was uneven. I have been unable to work for 6 weeks. I have lost income and accrued medical bills. What legal options do I have?

Re: fall

What city did this happen in?

The uneveness needs to be at least 2 inches and maybe even three inches. I would have to look that up again.

Re: fall

Where did the fall take place? And, how uneven was the sidewalk. The difference in elevation would have to exceed two inches, unless there are other attributing circumstances. If it is a public sidewalk, you will also have to prove the city was on notice of the condition. Please call me at 216.241.2500 with any questions you may have.

Re: fall

Take pictures of the uneven portion of the sidewalk that you tripped on. The rule in Ohio says that it has to be 2 inches or greater for liability to attach. You can sue the city for your damages. I have handled a number of these cases, call me if you wish to pursue this claim.
