Legal Question in Personal Injury in Ohio

My girlfriend was in a car accident that was not her fault. Approximately 6 months after the accident (while being pushed from specialist to specialist) the responsible party filed chapter 7 without us knowing. After nearly two years (just before the statute was up) and back surgery, she was offered a very low settlement for the insurance co. At this time she decided to sue the person at fault and found out they filed and were awarded bankruptcy. Do we have any rights?

If you filed a lawsuit against the defendant before the statute of limitations ran you should be okay. Your attorney needs to ask the bankruptcy judge to allow the case to move forward against the insurance company. If you don't have a lawyer get one immediately.
