Legal Question in Personal Injury in Ohio

i was involved in a 2 car accident in 2005 the accident was in actuallity the other persons fault but due to me having no insurance they faulted me at sentenceing i had the options of eighther paying restitution or taking a 3 year licence suspention. i took the suspention which i have served 2 years of at this time i was recently served with notification that i was being sued for the restitution again by the other accident participant is it not double jepordy to sue me over what i have already been sentenced for and am currently serving my suspention for how can i remedy this?

You must not have been represented during the license suspension issue, since restitution cannot be traded for a license suspension. You still owe the money and there is no doubt to that. Don't ever go into a courtroom without a lawyer.

You should talk directly to an attorney asap. This is especially true if the accident was not your fault. You may have a number of remedies available.

The short answer to your question is that the traffic case where you were ordered to make restitution is separate and apart from the "civil" action where the "other accident participant" has sued you.

I would want to know quite a bit more information. Was anyone injured in the accident? Were there any witnesses? Did the other party have insurance?
