Time limit on an auto accident?

My two son's where involved in a car accident in 1996 and they were 5 & 6 years oldone of them was hurt pretty bad. The son that was hurt is now 18 years old.Can he sue the person that hit them now? the person did not have any insurance and the hospital and dental bills where never paid.

The time limit for bringing an action for injuries from a car accident is 2 years. If the person injured is under the age of 18 at the time of the accident, the clock does not start until they turn 18. They then have two years to commence the action.

There may be some other issues that effect the answer but that is the general law.
