That is a good question. The answer will primarily depend upon who was at fault for the car accident. In addition to workers' compensation, your wife may also have a negligence/personal injury claim. Feel free to call me to discuss your options. (513-737-5180)

If the accident was your wife's fault, responsibility for the property damage most likely depends on the agreement that your wife had with the employer and insurance coverage. Your wife should be covered by worker's compensation that will cover lost wages as well as medical expenses. If the employer agrees to pay the medical, she will still want to make sure that a worker's comp claim is established in order to protect her interests later on.

She should talk to a worker's comp atty as soon as possible. It is important that her claim get established for the correct injuries. Most attys will talk to her without cost and will work on her case on a contingency basis.

Your wife's case raises a lot of questions. Feel free to give me a call and I will be happy to discuss this with you or her in more detail. 440-953-2000 800-953-2003 No charge or obligation for the call.

Good Luck!

As Mr. Tobergte and Mr. Davies have pointed out, the answer to your question (and related issues you probably haven't considered) necessitate a conversation with a qualified PI/comp attorney. Any reputable lawyer will meet with your wife for free and tell you what your options are.

I would also suggest not hiring someone too far away. Good luck!
