Wrongful Death

In a situation where there is definately cause to bring a wrongful death suit but the spouse of the deceased does not choose to pursue the case, can the grown children of the deceased file a lawsuit without the spouse? The children of the deceased were left nothing in the will, and this was stated by the deceased at the time he made his will because he did not want them to have anything.

A wrongful death lawsuit can only be brought in the name of the personal representative of the estate. Has an estate been opened yet?
