Legal Question in Real Estate Law in Ohio

Builders respopnsibility

We purchased a new condo about three years ago. It has a attached veranda but it was not a 4 season room. To better utilize it we decided to add heating/AC ducts and insulate it. When the heating contractors were installing the new ducts they pointed out that 1/2 of the attic wasn't insulated. I had an insulation contractor verify this and they said the same thing and said there could be other areas that might not be insulated. Since the unit is only three years old and it should have been totally insulated do I have any recourse with the builder or is this my responsibility?

Re: Builders respopnsibility

Hi,

1st: Do you have a contract. If yes, is the insulation mentioned in the contract? The contract controls.

2nd: Have you called the builder and complained?

3rd: Is it worth the expense or time of a law suit? If you win the law suit can you collect the judgment?

Try Small Claims Court if all else fails. It usually is affordable.

Good Luck,
