Legal Question in Real Estate Law in Ohio

I'm a condo owner. Before moving in 3mos ago, my builder dug up my front lawn w/out notification/permission & poorly reseeded it. Parts of the lawn now have no grass, other parts are mostly weeds & crab grass. For 3mos I've asked my Assn to resolve the problem. The lawn is a common area falling under their direct care. They told me its builders responsibility. Builder has not fixed the problem either. Now my weeds aren't even mowed on a regular basis (currently over 1ft tall!). My HOA fees are up to date & other front lawns in our development are well-maintained by the Assn. Is this a form of discrimination? What should I do?

One option would be placing your association on notice that you will place your dues/fees in an escrow account until they fix the issue. This should get their attention.
