Legal Question in Real Estate Law in Ohio

Driveway Encroachment

Until recently my driveway encroached on my neighbor's yard by about 3 ft. I removed encroachment and placed topsoil and sod in its place. I watered and cared for sod 2 weeks, then stopped as it is my neighbor's property and his responsibility now. Sod is dying in places and neighbor is threatening to put a lien against my property. Can he do that? What was my legal obligation after removing encroachment?

Re: Driveway Encroachment

I'm not 100% sure about the amount of restoration you need to do, since I don't know how the encroachment was created in the first place. However, he will need to sue you and win before he can put a lien on your property. They can't just be placed there. It would seem that you have taken reasonable steps. I'm not sure you need to do more.

Good Luck.
