Re: house

If dad was single when he died (he was divorced or his wife died before him) his children would be entitled to share his property equally. If you are an only child, you can apply to the probate court for permission to handle the payment of any legal debts and the transfer of the property to yourself. If you have brothers or sisters, you should all agree on having one of you make the application and the others can waive their right. The property remaining after payment of debts would then be divided equally.

It would be helpful to have the advice of an attorney but it is not required. You can go to the probate court for the county that dad was living in when he died and they will give you forms to fill out etc. They will not give you legal advice but they are usually very helpful.

If you would like to discuss this in more detail, feel free to give me a call.

Good Luck!
