Legal Question in Real Estate Law in Ohio

My mother had a house with her boyfriend. He had her in his will but since they have broken up. He passed away last Saturday, the house is still in both names. How can we find out if he still has her in his will and what to do about the house. She has since moved to NC so she wants to sell the house as soon as possible.

If the house is in both names and it has the language "joint with right of survivorship" it does not matter what the will says your mother is entitled to the house. If it is in both names without the survivorship language then your mother owns 1/2 of the house and you will have to determine what the will says. If the family is not going to file with the probate court she can take action to compel them to file.
