if my neighbor interferes with me building a partition fence on my property (Ohio Revised Code 971.08), can he be arrested?

Answer: Unless your neighbor becomes physical in his/her objections, and actually thereatens you with physical force, violence or physical interference, there is no basis for arrest, since no crime has been committed.

Howeveer, you may wish to seek legal protection in advance, by filing an action for protective or restraining order, if you feel truly threatened.

But, first, consult experienced legal counsel to advise and assist you, and to protect your rights.
