Legal Question in Traffic Law in Ohio

Summoned to Court on a Sunday???

I was pulled over this morning as I got off at--name removed--highway exit. The officer informed me I was clocked over the speed limit by a police chopper over the expressway. He proceed to write me a ticket, and he told me I could appear in court on February 19, and it was also written on the ticket. I am assuming this was probably a mistake, since it is a Sunday. I plan on showing up that day, and if the court is closed returning the next day to explain...is this a good idea? Should I fight it on the basis of it being a chopper, and the officer who wrote the ticket was on the ground and it is here-say?

Re: Summoned to Court on a Sunday???

You may want to check the date, time and location and see if this is a Mayor's court rather than actual court. I would suggest calling to confirm the date and time.

When being ticketed by aircraft, police must follow strict rules when presenting evidence at your trial including having the officer in the aircraft testify as to your speed, how he arrived at your speed and how he knows that you are the motor vehicle speeding. The officer on the ground then must testify as to why you were stopped and ticketed and to identify you as the driver of the vehicle. Lastly, the officer must testify as to the posted speed limit.

Good luck. Call my office if have additional questions.
