Legal Question in Traffic Law in Ohio

Ticket from police

My name is Leanna, my father had just recieved a ticket on 3/12/2009. The question deals with a traffic ticket issued by our Salem police department to my father. What happened seem absured to me, I would like to know what you think. My father was leaving a residence to go back to my house. He was driving my car (around 4:00pm). Later that same day (around 9:00pm) a police officer shown up at my residence (my father lives with me). The officer gave my dad a ticket for driving under suspension. The officer seen said that he had seen my dad driving down the road earlier. It is true that my dads license is suspended for failure to carry a required sr22 bond. I really can't see how the police can issue a ticket without even pulling my father over. He was driving my vehicle which the plates are in my name, and I am a valid driver. There has been a few other times in which I believe the police have went out of their way to try to harrass my dad. My belief was that the police could only give you a ticket if thI just think that this time is so unjust that I am willing to hire an attorney. If someone could please send some information about this issue back to me, I wouls greatly appreciate. Thank you...Leanna

If your question is, can the police issue a ticket at 9:00 p.m. for a traffic violation which allegedly occurred at 4:00 p.m., the answer is yes. If your question is, might your father benefit from having legal representation, the answer is also yes.

There doesnt seems to be anything wrong with what the officer did, since he says that he saw your father driving....that's illegal if his license is suspended. He would testify that he saw your father driving...if that's true your dad is guilty and could go to jail for 6 months, so be very careful here!
