Legal Question in Traffic Law in Ohio

My six year old car had been in storage and only had 10k miles on it. When I began driving it, it was totaled by a career criminal driving another person's uninsured vehicle. My uninsured motorist coverage reimbursed me for book value on a six year old vehicle. I had to add another 7K to the insurance check in order to purchase the same vehicle new in order to get any thing near the condition & mileage of my previous car. Do I have a case against the driver or vehicle owner for the additional 7k, or will a judge simply say it's my fault for not having stated-value insurance coverage on a 6 yr. old vehicle with that low of mileage?
