Legal Question in Wills and Trusts in Ohio

My brother is executor of my parents estate. It has been a year since my mother's death and the house still has not sold. He had the house on the market for three months to no avail and has not been on the market since. there is no money left to carry the mortgage and related expenses. He says his daughter wants to buy the house but is having trouble getting financed. I have a feeling that he is stalling until we are desperate to sell at any price. What are my rights as far as relieving him of his duties as executor?

You can file for a motion to remove the executor if you do not feel he is fulfilling his duties as executor of the estate. However, you must have good reason to do so. If you can prove that he is acting only to help his daughter get a good price on the house, you may have good reason for removal.
