estate after death

my oldest sister is ill and told me everything in her estate would be split evenly between me and my other sister. she told my other sister that she is in charge of everything and decided who gets what. no will. what can i do?

If your sister does not have a will then her property will pass according to the state statute. It would first go to her spouse, if she is not married it would go to her parents and then if she does not have any parents to her siblings in equal shares.

When you sister passes away either of you can apply to be administrator of her estate and would be able to handle the estate.

If there is no will and your ill sister made no other provisions, then her estate passes through probate court according to statute. The court appoints an administrator, usually a family member. If you are worried about your other sister being administrator, I suggest you consult with an attorney.

I agree with the two previous responses. This can be a fairly simple process to do on your own, however, it can sometimes be overwhelming to a lay person. It is a good idea to have an attorney to consult with during the process to get through it with the least amount of stress on your family.
