Legal Question in Wills and Trusts in Ohio

In the state of Ohio is it mandatory to establish an estate if the assets are less than $5000.00 ? If it is required what are the general attorney fees for this process and do they need to be paid up front or will this payment come from the estate?

It would depend on what the assets is and how it is titled at the death of the decedent. It if is the decedent's name alone, a full estate would not be necessary but just a release of assets from administration. The attorney can be paid up front but may also agree to be paid after the money is released however, there will be probate filing fees that must also be paid. The fees vary depending on the attorney and the fact of the case but are substantially much less that a full administration.
