Legal Question in Workers Comp in Ohio

cervical disc protrusion c5-c6

I am a RN. On 7/28/08 I was moving a patient's commode and fell hitting the side of my right face on the commode which in turn twisted my neckaround to the left side. I fell to the floor and do not remember much after that, the fall had caused me to go unconscious for a short time. I went through physical therapy, steroids and finally had an MRI done which showed a large disc protrusion at c5-c6 causing mild spinal cord compression. I have never had problems with my neck before this. Surgery is recommended by a neurosurgeon. The physician who reviewed the claim for worker's comp. denied my payment doe time off work and denied surgery due to having other degenerative changes in my MRI and that the mechanism of injury would not cause disc protrusion. My question is do I have a case to fight workers comp.? I cannot believe a physician who has never seen me and does not know my history can deny this case.

It is very important that you appeal the decision by the bureau. if you fail to timely appeal you will be unable to have a hearing on the issue.

As these matters may get complicated, i would advise that you obtain representation from an experienced workers' compensation attorney.
