Legal Question in Workers Comp in Ohio

Husband was in accident while driving for his job route. He is on work comp payments, he has been left with TBI plus other injuries, it has been 2 years since accident. Question is, his Dr. made comment over year ago that he will get settlement, he did receive small settlement from 3rd party, after paying attorney and the subrogation interest, he did not get even 1 1/2 years of wages. To get settlement from BWC does he start the process or will his employer ? No one has talked to him regarding this. Should he talk to BWC or employer ? Or does this type of settlement just happen ?
