Legal Question in Business Law in Oklahoma

In December I purchased a xbox 360 hard drive on eBay. It worked until march and then malfunctioned. I bought a warranty for it but the warranty provider instructed me to contact the seller first. I contacted him through eBay and he said that he would replace the item. It's been three weeks since he claims he sent it but he will not give me a tracking number and appears to be giving me the runaround. He claims that he mailed it first class and it shipped international and claims that there isn't a tracking number but the postal service told me that they always have a tracking number. What can I do to either recieve my item or my money back

eBay typically has a Code of Conduct or Rules and Regulations about unethical or fraudlent conduct imposed by its clients. If this is what you are experiencing the seller MUST be reported. And, if you have all the seller's information, i.e. name, address and phone number, you can file a civil suit for recovery.

In the meantime, it is recommended you document any conversations with the seller to use as proof in court. I hope this helps.
