Can a law firm sue me for the cost of suing me? Here's the situation: I paid my legal bill to a firm that represented me, making payments every month without fail. At the very last month, I was served for small claims based on the allegation that I had not paid my bill. I made the final payment and supplied proof of my payments to the judge in my response. It's months later, and the firm acknowledges my payments of the original bill, but they believe that since filing a case cost them a few hundred more dollar, I owe them for that. So even though it was a pointless suit to reclaim a debt that was fully paid, they believe that filing the goofy thing merits still more compensation for their time. I think it's bogus, they think it's fair. Can they sue me purely to reclaim the cost of suing me, when my bill had been paid?

Costs and attorney fees incurred in litigation can, in certain situations, be recovered. However, recovery must be sought in the original action.
