My brother-in-law wants to get guardianship of his middle daughter(14 years old). Her mother has told me(I am the aunt to the daughter,my husband is her fathers brother), that she is tired of her daughter, calls her names, and wants to be rid of her.

my brother-in-law wants to know what he has to do to acquire guardianship of his daughter. The daughters mother has already called the local authority on her daughter for leaving the house(she doesn't get along with her step-father),and the police have informed the daughter that she is to stay in the house until her mother sends her to the JONES ACADEMY in oklahoma. She wants to be rid of her, says she is nothing but every name in the book. Her father wants her, and is willing to take her. Please help!!

Guardianship is not the proper procedure. If the child is your brother in law's dauther, then the appropriate procedure would be for your brother-in-law to obtain custody of his daughter. If the mother is agreeable, and there has been a previous custody order entered, then the procedure is simple. The pleadings are drafted and the mother signs them and the judge approves it.
