Legal Question in Family Law in Oklahoma

Is husband entitled to half of disability income?

My husband and I have been married for ten years and we have two kids, 8 & 9. He wants a legal separation. This year I started receiving disability for my bipolar disorder. I recently was sent a very large check for money withheld for SSI which I didn't apply for. The reason I filed for social security is because my marriage was on shaky ground and I wanted to protect myself and my kids. I have not worked steady for ten years. My husbands gross annual income is 93,000.00. Should he be entitled to half of the large amount of disability pay, and should I be responsible for half of the debt in the marriage? My annual income from disability is 8,472.00. The debt owed is some credit card bills, medical bills and some money owed on a house we recently sold. We both would like to handle this separation out of court if possible and I just want what is best for the children and what is fair for myself.

Desperate For Some Answers,

Thank You

What should happen and what does happen are often very different. I think that with a 10:1 difference in your income, you need to be talking to a lawyer face to face and not trying to do this alone. You can bet he has talked to one!
