Am I legally responsible for our debts

My husband and I are divorcing. He is in the military and is cheating on me. My question is Am I responsible for 1/2 the debt? We lived in Germany almost our entire marriage so I couldn't get a career going, now that I am back in the states I will be starting school in April. I do not have a job, I am living with my mom, we have an 18 month old son that is here with me. Any help in answering this would be greatly appreciated.

The Court is charged with dividing the marital assets and debt "equitably". That often, but not always, means 50/50. In your case, you should not be responsible for 1/2 the debt because you do not have the ability to pay the debt, and that would not be equitable. For an attorney to advise you on what is a fair division, one would need to know many things, such as: how much debt you have, what your husband makes, how long you will be in school, what you can earn after completing school, what assets each of you have(marital and seperate), etc. You should also explore the issue of support alimony.
