Without more facts to work with I would recommend that you look into a guardianship for your nephew. A guardianship allows for someone to legally exercise custody over a minor. This is important in some instances where the custody will last for a prolonged period of time and the guardian needs a legal document which allows them to make choices as school enrollment, doctor visits, etc. A guardianship will alow for this while at the same time allow for the parents to regain custody at a later time if that is what you want to happen.

A guardianship can be handled without an attorney, but it can be a difficult process and may require the assistance of an attorney.

You can find a good resource for the guardianship process and the necessary forms online at http://www.peapods.us/UserFiles/File/Guard_-Relative-Guardian_-Handbook.pdf. This guide will get you headed in the right direction to determine if a guardianship is the right choice for you.
