How to pass assets from a first marriage on to the children of that marriage aft

My father age 88 has a will dated 1995 from Kansas when he was a resident asking that all his assets go to his three children. In 2000, he moved to Oklahoma and remarried. His second wife wants his assets to pass to his children and her assets to pass to her children. Can this happen without a will or some other legal device?

Your father needs to speak with an Oklahoma attorney to review his Kansas will, and advise him about any statutory rights of his spouse, such as electing to take against the will. Depending on the size of his estate, there may also be estate tax implications which should be factored into the planning process.
