A question about child custody

If u got a dna done and now the father is paying child support does that give him rights to take him from me in court even if he is not listed as the father on my sons birth certifacte?

"Take him"? Not without going to court and the test the judge considers is -- what is in the best interests of the child. You don't provide many facts in your inquiry, but unless something is radically different from other cases, I doubt that the judge would allow him to be the possessory conservator (take him). When the DNA test proved this man was the father, the Court Order that ordered him to pay child support formally made him the father of the child no matter what the birth certificate says. As the father he has the right to take you to Court to try to get custody of his child. Whether or not he will win depends on many things.
