Minors and knives

10 yr old has a real flip-out knife (blade 3-4in) out playing with it around another child. A parent takes the knife away. The boy's adult brother comes over to retrieve the knife that he says is his. The parent says that only a parent of the 10 yr old will get the knife back. Question: Does the parent have to give it back to the brother?

Since the brother is an adult, and you know he is the brother, I don't think giving the knife to the brother would be unreasonable; certainly it would not be unlawful to do so. Likewise, giving the knife to the parents would be a reasonable action.

Since the parents are legally responsible for the child, holding the knife so as to give it to the parents makes sense; however I would suggest you proactively make contact with the parents and explain the chain of events and your reasoning for handling it the way you have.
