Legal Question in Immigration Law in Oklahoma

I am a US citizen from Oklahoma, and have a fiance from Sweden. Would it be easier and less expensive to marry before he goes back or wait until he is approved for a marriage or fiance Visa? I have heard rumors and blogs on both stating completely opposite views.

We are both adults , no criminal history and eligible for marriage in all other aspects.

Thank you :)

If he is presently in USA, yes, you can marry and apply for his adjustment of status (green card), provided that he is 1) eligible for adjustment, 2) not deportable, 3) you can sponsor him, etc etc.

If he is abroad and you two met in person at least one time within the past 2 years, you can apply for a Fiancee visa.

If he needs to go back to Sweden soon, you can marry and apply for his immigration via Consular Processing (where he will wait abroad and apply for an immigrant visa).

Whichever option is most appropriate, safe, fast and/or beneficial for you two - should be decided after consulting with an attorney in private.
