Legal Question in Employment Law in Oklahoma

Immunization for employees traveling overseas: a reasonable request?

Does an employer have the responsibility to provide the recommended (WHO, CDC, etc...)immunization to an employee traveling on behalf of the firm to the country of Yemen for thirty days or more? Would the request by the employee be considered unreasonable and cause for discharge?

Employer Mandated Immunizations

An individual's health care decisions are covered by the privacy protections of the California Contstitution. The employer's best course would be to advise the employee of the recommended immunizations and the dangers if he is not imunized, and leave it to the employee as to decide. Discharge may result in a lawsuit.

If the employment has sufficient connections to California, the employee would be covered under California workers' compensation law in the event he becomes ill, and the illness arises in the course and scope of employment.

The above is meant to assist in a general understanding of the current law relating to employment matters. It is not to be regarded as legal advice. Companies or individuals with particular questions should seek advice of counsel before taking any action.
