Legal Question in Employment Law in Oklahoma

workers comp retaliation

is it legal for an employer to change my job description after A workers compensation claim? My doctor released me to go back to full duty. my boss said that it is because business is slow. However, they just traded places between myself and the order puller. Now my job is more strenuous and I get fewer hours. Is this acceptable? Your input would be greatly appreciated.

Re: workers comp retaliation

This is a difficult question without more information. If you have proof that there is retaliation and you are being run off from the job, you may have a case. If there is no such proof, employers are allowed a great deal of latitude in this state. Additionally, you did not mention if you collected for any permanent disability that you may be entitled to, or other potential benefits. Keep good documentation of the events going on, and if they eventually get rid of you, then speak with an attorney. If you did not have an attorney in the injury claim, I would recommend that you speak with an experienced workers' compensation attorney prior to agreeing to anything further. Please feel free to contact me at (918) 227-4009, or [email protected]. I hope this helps some.
