Legal Question in Real Estate Law in Oklahoma

20 years ago my common law husband and I bought a piece of property together(with me using his last name)

as husband and wife. He has lived out of the country for the past 4 years, and has paid none of the taxes on the property, but I have. I have lived in the house for the past 20 years, claiming it as my home openly. There is no mortgage on the property. How can I legally get his name off the title and change my

name on it to my maiden name which I use now?

One way is to bring a quiet title action in the district court of the county where the real property is located. Of course, you can ask him to deed the property to you. If he does not, then you have to file suit. Your payments and expenses will ultimately be deducted from his share of the property.

Better method is to file for divorce and or petition the court for change of name. The property issues will be decided the same time.
