What is Probate and who is entitled?

My father died two weeks ago without a will. He was known not to have any family members. I recently found out through DNA that he was my father. At the funeral I discovered that I had a cousin that states she had been the only person keeping contact with my father and felt that she deserved anything he owned. I would like to know if she is entitled to anything, how long does probate take to complete and what exactly is probate?

go see an Atty in your area. Probate is a messy business and you cannot go it alone!

Probate is the court authorized method of determining the fact of death, determination of heirs, payment of debts and distribution of the assets to the proper people. In times past it has been impossible to establish heirship after the death of the reputed father. State statutes did not allow for it. In the back of my mind I am thinking that this has been changed by statute or court decision so that it can be done. However, This issue would need to be researched again in order to give you a definitive answer. In short, you need an attorney to get involved NOW.
