Consumer rights to fire attorney

A family member hired a attorney for a wrongful death case but the family has done a great majority of the leg work involved in the case. The buisness that is getting sued wants to meet and asked if they had a attorney. The family said yes and the buisness has not been contacted by the attorney at all and five months have passed. The buisness has admitted fault and wants to settle at this point. Can the attorney be let go at this point or does the family have an obligation to continue with the services?

You will want to check your retainer agreement. Usually such agreements provide that either party can terminate the employment with a certain number of days (i.e. 7 days) written notice. If there is no retainer agreement then of course you can terminate the employment. I would still provide written notice to the attorney and also provide written notice to the other side that said attorney no longer represents you.
