pharmacy license

police found pipe in pocket, entered into evidence on duii charge 5 years ago. I applying for a pharmacy tech license. never charged with possession. went through diversion and completed. board of pharmacy is using mention of pipe as proof of substance abuse. I believe the judge dissmissed the evidence because I was never charged/fined. can the board use the mention of a pipe under these circumstances against me?

Your career may rest on the answer to your question, and whomever answers it will need to ask you more questions. As such, I urge you to at least VISIT with a lawyer who is familiar with this area of the law. At one time, I know that SAM KAUFFMAN (look him up at osbar.org)handled cases involving professional boards in Oregon, and I think he still does. You might also contact the Oregon State Bar's Lawyer Referral Service.

If the pharmacy board uses this against you, it would seem inappropriate, from a public policy point of view. Legally, it may be a very different matter. Get some professional help on this, in person.
