Legal Question in Civil Rights Law in Oregon

My son is in Prison in Oregon and the mother to his child has set up a Myspace page for him and also a FaceBook for him, knowing that he is in prison. She has put info on there and pictures on there of different things. A lot of his son (My Grandson). She has put that he is in a relationship with here, which she is not. And there have been people writing on his page. She has put friends on his page that I dont know if he even knows them or not.

So my question(S) is, Since she did this is there anyway to prove that she did it? and is there something that can be done about it? Can he get into trouble more for her doing it maybe becasue they think he did it from prison since they have them there/ I'm sure they have this stuff blocked so that they cant do it.? This makes it look like he is out which he has 4 more years to go. I have made copies of the Myspace page, but have not of the facebook page yet.

Thanks

It should be pretty easy to prove he is not updating the pages. He can ask the prison to take away any computer privileges he may have for a couple of days. the sites will get updated anyway, thus proviing he is not doing it from prison.

To stop her from placing information on the page, have an attorney send her a "cease and desist" letter, telling her to terminate the sites. If she does not, the letter can say, she can be sued for interfering with your son's opportunity to minimize his prison time and for impersonating him online. If she does not remove the sites, I would contact the administrator of the prison system and ask him to contact her about this.
